Terms of Service

1. Acceptance

By visiting odasiti.com, joining the Odasiti waitlist, or using the Odasiti mobile application, you accept these Terms of Service in full. If you do not accept them, do not use the service.

You must be at least 18 years old to accept these terms (see §4).

2. Who we are

Odasiti is a registered business name operated by Tesaroche Pty Ltd, an Australian company. In these terms, “Odasiti”, “we”, “us”, and “our” refer to Tesaroche Pty Ltd in its capacity as operator of the platform.

3. What we provide

Odasiti is a connection platform built around five Levels:

• Level 1 · Discover: a waitlist landing site at odasiti.com and its subdomains; a waitlist registration mechanism; the Odasiti mobile application (in active development and available via TestFlight / Google Play testing channels).
• Levels 2 – 5: progressive exchange (text, voice notes, and calls), meetup coordination, in-person reveal, and post-meetup feedback. These Levels are available in the mobile application when your country is open and a match is in progress.

The Odasiti platform is in active development. Features are released progressively and availability varies by country. We make no representation that any specific feature will be made available in your country, or at all.

When they are released, updates to the service will be covered by these terms, and the “Last updated” date at the top of this document will reflect any changes.

4. Eligibility

To use Odasiti you must:

• Be at least 18 years old.
• Have legal capacity to enter into a binding agreement in your jurisdiction.
• Not be on any sanctions list maintained by the Australian government or by any other jurisdiction whose law applies to you.
• Use no more than one account per person.

If we determine you do not meet these requirements we may suspend or terminate your access without notice and without refund.

5. Subscriptions and billing

Odasiti offers optional paid memberships (Nurture and Commit) alongside the free Explore tier. Prices, features, and billing intervals are shown in the app before you purchase.

• Payment processors. Web purchases are processed by Stripe. Apple App Store and Google Play purchases are processed by those platforms (and RevenueCat as our subscription management provider). Their terms apply to those transactions.
• Auto-renewal. Subscriptions renew automatically each billing period unless you cancel before the renewal date. You can cancel in the app (Settings → Subscription) or through your Apple or Google subscription settings for store purchases.
• Refunds and cooling-off. Australian consumers may have rights under the Australian Consumer Law. For annual memberships purchased through our website, we offer a 14-day cooling-off refund where shown in the app (Settings → Request a refund). The eligibility rules in the app apply. Apple- and Google-mediated purchases must be refunded through those platforms.
• Tier changes. Downgrading takes effect at the end of the current billing period. Some features (including full Scrapbook access and certain games) require Commit. Level 2 Exchange and beyond matches may pause if you return to Explore, as described in the app.
• Founding Member and referral credits. Waitlist referral rewards (such as premium months earned when friends verify) are promotional credits applied subject to the rules shown at signup and in the app. They do not transfer cash value and may expire or adjust if your account is closed or your country is not yet open.

6. Your account

When you join the Odasiti waitlist, we create a record of your email address, your country, and the preferences you indicated at signup. When your country opens and you activate the mobile application, a full account is created using the profile name you choose.

You are responsible for keeping your login credentials secure. You must not share your account with anyone else or allow anyone else to use it. If you believe your account has been compromised, contact us immediately at legal@odasiti.com.

Your account and all information we hold about it is governed by our Privacy Policy.

7. Acceptable use

You agree that you will not:

• Submit signups or messages using identities or addresses you do not own, or that you have generated programmatically.
• Attempt to circumvent country-rollout assignment.
• Harass, intimidate, threaten, or harm other users.
• Share, seek to obtain, or request another user’s personal contact information (phone number, social media handle, address) through the platform. The platform is designed to progress connections at its own pace; circumventing that is a violation of these terms.
• Provide an emergency contact phone number without that person’s permission, or misuse emergency-contact notifications.
• Use compatibility scores or the Compatibility Dashboard to harass, rank, or compare users outside your active match. The overall compatibility index is shown only between you and your match.
• Arrange in-person meetups outside the platform’s safety features in a way that puts you or others at unreasonable risk, or ignore reasonable safety guidance in the app.
• Attempt to extract, scrape, or acquire data from the service through means we have not provided as a public interface.
• Reverse-engineer, decompile, or attempt to derive the source of any software we make available.
• Use the service for any unlawful purpose, or in any way that infringes our rights or those of any third party.
• Interfere with the operation of the service, including by submitting requests at a rate inconsistent with normal human use.

We reserve the right to terminate access for any violation of this section without notice and without refund.

8. Intellectual property

All content, features, branding, layout, and software that make up the Odasiti service are owned by or licensed to Tesaroche Pty Ltd. The Odasiti name, logo, and associated marks are trademarks of Tesaroche Pty Ltd.

You may use the public-facing portions of the service for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from the service except as allowed for routine browser caching and normal use.

Content you contribute to the platform (chat-game responses, voice notes, scrapbook items) remains yours. By contributing it you grant us a limited, non-exclusive licence to process, store, and display it as necessary to operate the service. We do not use your content to train AI models.

9. Disclaimers

The service is provided “as is” and “as available”. To the extent permitted by law, Odasiti disclaims all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no representation that:

• The service will be uninterrupted, error-free, or secure.
• The waitlist will deliver any particular outcome to you.
• Any specific feature will be released in your country, or at all.
• Any match, connection, or in-person meeting will be made available to you.

Nothing in this section excludes or limits any non-excludable consumer-protection rights you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or under any other applicable mandatory consumer-protection law.

10. Limitation of liability

To the maximum extent permitted by law:

• Tesaroche Pty Ltd’s total liability to you arising out of or in connection with these terms or your use of the service is limited to the greater of AUD $100 or the amount you have paid us in the 12 months immediately preceding the event giving rise to the liability.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages.

Nothing in this section excludes or limits any non-excludable consumer-protection rights you have under the Australian Consumer Law.

11. Termination

We may terminate or suspend your access to the service:

• If you breach these terms (including §7 Acceptable use).
• If we discontinue the service, with reasonable advance notice where practical.

You may leave at any time. To request deletion of your account and waitlist record, contact us at privacy@odasiti.com. We will process your request in accordance with our Privacy Policy.

12. Changes to terms

We may update these terms from time to time. Material changes will:

• Update the “Last updated” date at the top of this document.
• Re-show the cookie banner so you can review the change before continuing.
• Be communicated by email to subscribers who opted in to marketing communications, where the change is significant.

13. Governing law

These terms are governed by the laws of Western Australia, Australia. The courts of Western Australia have exclusive jurisdiction to resolve any dispute arising out of or in connection with these terms, except to the extent that mandatory law in your jurisdiction provides otherwise.
